This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T Case No.02 of 2018(NDPS), on the files of learned Sessions Judge-cum-Special Judge, Bhawanipatna, arising out of Bhawanipatna Sadar P.S. Case No.72 of 2018 corresponding to S.T.F. P.S. Bhubaneswar vide P.S. Case No.01 of 2018, under Sections 20(b)(ii)(C) of the NDPS Act and is in custody since 23.03.2018.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bhawanipatna, by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking note of the submission of the learned counsel for the petitioner that trial has already commenced, this Court is not

inclined to entertain this bail application at this stage. The same stands rejected.

It is submitted that the petitioner is in custody since 23.03.2018. Taking note of the same the learned Court in seisin over the matter is called upon to conclude the trial within a period of four months from the date of receipt/production of the certified copy of this order.

In the event trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer, if so, advised.

Accordingly, the BLAPL stands disposed of.
