This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in 2(a)C.C. Case No.25 of 2022, on the files of learned J.M.F.C., Bhapur arising out of Nayagarh P.R. Case No.21 of 2022-23, under Sections 52(a) of the Odisha Excise Act, 2008 and is in custody since 10.07.2022. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Nayagarh, by order dated 02.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the punishment prescribed and keeping in view that the petitioner is a lady, invoking the proviso to Section 437(1) Cr.P.C., this Court
directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter. 6.
Accordingly, the BLAPL stands disposed of.
