1. The matter is taken up through Hybrid mode.
2. Mr. K.C. Tripathy, learned counsel appearing for the Appellant has submitted that he will not press the appeal as the Respondentwife did not come forward to vouch his consent on the petition filed under Section 13-B of the Hindu Marriage Act, 1955. However, Mr. Tripathy, learned counsel has submitted that dismissal of the appeal may not stand in this way to file an independent suit for divorce for dissolution of marriage.
3. In terms of the above statement, this appeal stands dismissed as not pressed. However, liberty as prayed for, will remain with the Appellant.
