3. 1. By filing the present petition, the petitioner alleges non-compliance of the order passed by this Court dated 22.02.2022 disposing of W.P.(C) No.3255 of 2022 and further prays the Court to proceed against the opposite party as per the provisions of the Contempt of Courts Act, 1971.

Pursuant to the orders dated 26.10.2022 and 25.11.2022 instructions have been obtained by Shri Manoj Kumar Khuntia, learned AGA from Shri Sudhansu Sekhar Sao, Tahasildar, Dhenkanal through one of his officials who is present in person in Court today. On the basis of such instruction received from the Tahasildar, Dhenkanal on behalf of Collector, Dhenkanal, it is submitted by learned AGA that the process of detailed verification of the documents to establish the bona fide of the present petitioner as a claimant for the benefits/compensation for his lands acquired for the super thermal power plant of the National Thermal Power Corporation Ltd. at Gajamara in the district of Dhenkanal would take some further time and thereafter the amount of compensation shall be released. It is further submitted that further time may be granted to complete such process.

In view of the aforesaid submissions of the learned AGA on the instructions of the appropriate authority, the present petition is disposed of observing that on completion of the process, as indicated above, the petitioner shall be paid the admissible amount towards compensation/benefits as early as possible but not later than 31st January, 2023. It is further observed that the petitioner shall have the liberty to revive the present petition in case the amount as would be found due and admissible, is not paid to the petitioner by 31st January, 2023.
