CORAM:
JUSTICE BISWANATH RATH
ORDER
20.09.2022 Order No.
02.
1.
Heard learned counsel appearing for the parties. 2.
This Writ Petition involves a challenge to the order dated 07.02.2020 passed by the Tahasildar on the premises that even if the Tahasildar passing final order dated 23.02.2019 issuing direction for correction in the record-of-right, through the impugned order attempt has been made by the same Tahasildar to review his own order. For the clear disclosure through order dated 23.02.2019 having been passed on a report of the Revenue Inspector dated 22.01.2019, learned State Counsel does not see any possibility of any objection to the allegation raised herein. 3.
In the circumstance and for clear disclosure through the recording dated 22.01.2019 and 23.02.2019, this Court finds, there is no possibility in passing the order dated 07.02.2020 by the Tahasildar, who had already lost its jurisdiction over the matter for
// 2 // his final order already there. As a consequence, this Court sets aside the direction of the Tahasildar dated 07.02.2020 and directs the Tahaildar, Konisi-Opposite Party No.2 to work-out his order dated 23.02.2019 by completing the entire exercise within a period of fifteen days from the date of communication of certified copy of this order by the Petitioner.
4.
The Writ Petition stands disposed of with the above order. (Biswanath Rath) Judge Ayaskanta Jena
