The Petitioner has filed this Writ Petition seeking direction to the opposite parties to consider the case of the petitioner on the recommendation vide Annexures-3 and 4 made by the opposite party no.4 within a stipulated period.

Mr. Deo, learned counsel for the petitioner contended that the petitioner had earlier approached this Court by filing W.P.(C) No. 9066 of 2011, which was disposed of vide order dated 15.04.2011 directing the Collector, Sambalpur to take a decision in the matter by the end of April, 2011, if it is still pending and till the end of April, 2011, no coercive action shall be taken against the petitioner. But fact remains, after the order was passed on 15.04.2011, it is contended that the same has not been complied with.

In view of the above, it was open to the petitioner to file contempt application for non compliance of the order of this court instead of filing present writ petition after long lapse of more than 11 years. Therefore, the writ petition suffers from delay and laches and accordingly the same stands dismissed.
