Heard Mr. A.K. Mohanty, learned Counsel appearing for the Petitioner and Mr. B.B. Mohanty, learned Counsel appearing for Opposite Party No.5.

Mr. B.B. Mohanty, learned Counsel appearing for Opposite Party No.5 contended that pursuant to Order dated 19.05.2016 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.2977(C) of 2012, the benefit has been extended to Opposite Party No.5 by giving him appointment. It is also contended that in the meantime, Opposite Party No.5 got promotion and also retired from service on attaining the age of superannuation.

In view of the above, nothing remains more to be decided in this Writ Petition. However, if any cause of action survives, it is
open to the Petitioner to take necessary steps in accordance with law.

With the above observation, the Writ Petition stands disposed of.
