The Petitioner, who was a participant for allotment of IMFL OFF shop by way of lottery system, has filed the present petition aggrieved with the non-deciding of the appeal filed under Section 6 of the Odisha Excise Act, 2008 against the order dated 23rd June, 2021 passed by the Collector, Ganjam forfeiting the earnest money deposited for participation in the lottery system. It is thus, prayed that the Excise Commissioner, Odisha is required to decide the pending appeal expeditiously.

At the time of hearing, Mr. L. Samantaray, Additional Government Advocate upon instruction submits that the aforesaid appeal already stands decided vide detailed speaking order dated 13th August, 2021, which was duly communicated to the Petitioner. 4.

At this stage, counsel for the Petitioner prays for permission to withdraw the present writ petition to enable his client

// 2 // to file a fresh petition with better particulars challenging the aforesaid appellate order.

In view of the above, the writ petition is dismissed as withdrawn with the aforesaid liberty.

Issue urgent certified copy as per rules.
