This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.29 of 2020 pending in the file of learned Special Judge, Gajapati, Paralakhemundi, arising out of Adava P.S. Case No.48 of 2020, under Sections 25/29 and 20(b)(ii)(c) of the NDPS Act and is in custody since 25.06.2020.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Gajapati, Paralakhemundi by order dated 11.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the communication from the learned Sessions Judge-cum-special Judge, Gajapati, Paralakhemundi that out of 16 number of charge sheet witnesses, 08 number of witnesses have

been examined and the case was posted to 06.09.2022 and 07.09.2022 for further trial.

Taking into account the factum of ongoing trial, this Court is not inclined to entertain this bail application at this stage. 7.

Learned Court in seisin over the matter is called upon to conclude the trial within the period of two months from the date of receipt/production of the certified copy of this order. 8.

In the event, trial is not concluded within the time stipulated, it shall be open to the petitioner to move for bail afresh. 9.

Accordingly, the BLAPL stands disposed of.
