This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for State.

The petitioners are accused in G.R. Case No.198(D) of 2009 corresponding to Chandrapur P.S. Case No.8 of 2009, pending in the Court of learned Additional Sessions Judge, Gunupur (Circuit at Bissam Cuttack), under Sections 341/386/307/34 of IPC read with Section 25/27 of Arms Act.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Gunupur (Circuit at Bissam Cuttack), by order dated 21.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Learned counsel for the petitioners submit that the petitioners are in custody since 15.07.2022 and since charge-sheet

has already been filed, there is no justification for continuance in custody any further.

Learned counsel for the State relying on the statement of one Madhusudan Nalla and Pramila Sabar states that specific overt act has been attributed to the petitioners.

Taking into account the statement of the witnesses as stated, this Court is not inclined to entertain this bail application at this stage.

Accordingly the BLAPL stands rejected.
