The matter is taken up through hybrid arrangement (virtual/ physical) mode.

This is the successive journey of the Petitioner, who is in custody in connection with Paradip Lock P.S. Case No.123 of 2021 corresponding to C.T. Case No.34 of 2021 on the file of learned Additional Sessions Judge, Kujanga running for alleged commission of offence under section 457/328/395 of the IPC read with section 25/27 of Arms Act, in filing this application under section 439 Cr.P.C., has prayed for his release on bail. 3.

Heard.

Considering the submissions made and on going through the materials as placed and further keeping in view the surrounding circumstances including the period of detention of the Petitioner in custody and the factum of release of co-accused persons, namely, Kalia @ Ramakanta Parida, Dipak Sutar, Rajesh Mahali @ Raja and Amit Kumar Kar @ Adi @ Aditya on bail by the orders passed by this Court in BLAPL No.5889 of 2022, BLAPL No.8883 of 2021, BLAPL No.8888 of 2021 and BLAPL NO.8828 of 2021 respectively, while being inclined to

// 2 // reconsider the prayer for grant of bail to the Petitioner; it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that that he will appear in person before the court in seisin of the case on each and every date of posting of the case till conclusion of the trial; and will not indulge himself in commission of similar type of offence.

Violation of any of the above condition(s) shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
