This matter is taken up through Hybrid mode.

The Petitioner apprehending his arrest in Airfield P.S. Case No.294 of 2018 registered for alleged commission of offence punishable under Sections 120-B/294/420/468/471/506 IPC has filed this petition for his release on pre-arrest bail. 3.

Heard learned counsel for the Petitioner and learned counsel for the State. None appears for the informant. 4.

It appears that the earlier prayer for pre-arrest bail of the Petitioner was dismissed for non-prosecution. The Petitioner has again renewed the prayer for pre-arrest bail in this application.

It is submitted by the learned counsel for the Petitioner that the co-accused persons have already been released on bail

// 2 // in ABLAPL No.13597 of 2018 and BLAPL No.6554 of 2018. The Petitioner stated to have similarly situated with them is not disputed by the learned counsel for the State. 6.

This case arises out of a complaint case. Pursuant to the direction made under Section 156(3) Cr.P.C. in ICC Case No.3161 of 2018, the aforesaid case has been registered against the Petitioner.

Considering the facts and the submissions made, this Court directs that in the event of arrest of the Petitioner in connection with the aforesaid case, he be released on bail by the Officer effecting arrest on such terms and conditions as deemed just and proper.

However, the aforesaid order is subject to the condition that the Petitioner shall cooperate with the investigation and no other graver offence is reported against the Petitioner besides the aforesaid offences.

The ABLAPL is, accordingly, disposed of being allowed.

Urgent certified copy of this order be granted on proper application.
