This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned counsel for the State.

It is submitted by learned counsel for the petitioners that the ABLAPL No.9774 of 2022 was disposed of by order dated 16.08.2022 granting bail to the petitioners but, the said order was modified vide order dated 14.09.2022 in I.A. No.1461 of 2022 and further modification has been prayed for.

It is submitted by learned counsel for the petitioners that the petitioner no.1 is a chronic patient and due to severe flood, the house along with the agricultural land of the petitioners' damaged severely for which they are not able to furnish cash security. Hence, modification has been prayed for.

Accordingly, it is directed that the order dated 14.09.2022 in I.A. No.1461 of 2022 the condition for cash security in paragraph-4

// 2 // is waived, rest part of the order shall remain intact. 6.

Four weeks' further time from today is extended for the petitioners to file appropriate application before the opposite party authority, but subject to depositing cost of Rs.500/- (Rupees five hundred) in the Advocates' Welfare Fund of Orissa High Court Bar Association within fifteen days and furnish money receipt thereof in proof of deposit.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the petitioners to file appropriate application shall stand revoked automatically. 8.

The I.A. is disposed of accordingly.

Urgent certified copy of this order be granted on proper application.
