01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "Under the aforesaid facts and circumstances, it is therefore prayed that Hon'ble Court may graciously be pleased to:- (i) Direct the opp. Parties to grant 2nd Financial Up-gradation under R.A.C.P. of G.P. of Rs.4600/- w.e.f. 01.01.2013 on completion of 20 years of service as Amin, as has been given to other similarly situated persons, viz. Antaryami Mohanty, Brajendra Mishra and Others as at Annexure-7 & 9, pursuant to F.D. Resolution dated 14.01.2016 vide annxure-2 and 8 and then revised 3rd MACP under O.R.S.P. rules,2017 w.e.f.02.09.2021 on completion of 30 years of service;

(ii) Pass such other order(s) or issue direction(s) as may be deemed fit and proper in the bona fide interest of justice.

// 2 // And for this act of kindness, the Petitioner shall as in duty bound, ever pray."

4. Learned counsel for the Petitioner further submits that through highlighting his grievances, the petitioner has filed an application at Annexure-10 to the Writ Petition before the O.P. No.1, but till date nothing has been done in the matter. In such background, learned counsel for the Petitioner prays that a direction be issued to Opposite Party No.1 to take a decision on the above noted Petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.1 to take a decision on the above noted petition taking into account Annexure-8 & 9 within a period of three (3) months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.
