01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. B.B. Mohanty, learned counsel for the Petitioner and Mr. A.P. Das, learned ASC appearing for the State-Opp. Parties.
3. The present writ Petition has been filed with the following prayer:- "Under above facts and circumstances it is humbly prayed that this Hon'ble Court may graciously be pleased to issue a writ in appropriate nature directing the respondents to quash the Resolution dated 1.6.2017 of Agriculture & F.E. Department under Annexure-6 so far as the decision to include the 36 posts of Assistant Agriculture Engineers sanctioned and created by Resolution dated 16.03.2015 of Water Resources Department under Director CADIPM under Annexure-4 and this Hon'ble Court may further be pleased to quash the decision to fill up those 36 posts of Asst. Agriculture by way of Advertisement No. 3 of 22-23 by OPSC under annexure-7 by suitably directing the Agriculture Department to revise its requisition regarding vacancy
// 2 // position by deducting it by 36 posts from under Annexure forthwith or within a time to be stipulated by this Hon'ble Court.
And pass any other order/orders as would be deemed fit and proper and for which this act of kindness shall ever pray."
4. From the pleadings available in the writ Petition, it is seen that the Petitioner prior to raising their grievance in the present writ Petition have never approached the Authority. Therefore, this Court while disposing the writ Petition, permits the Petitioner to raise their grievance before O.P. No. 2.
5. It is observed that if any such application is made within a period of seven (7) days from today, O.P. No. 2 shall take a lawful decision on the same within a further period of one month. While considering the grievance of the Petitioner the points raised in the present writ Petition regarding the resolution issued by the Agriculture Department on 01.06.2017 under Annexure-6 be taken into account also.
