It is submitted by the learned counsel for the Petitioner that on a plain reading of the F.I.R., no case under section 376 of the Indian Penal Code is made out against the Petitioner. 5.

Considering the nature of allegations made, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned Special Judge (POCSO), Balasore in Special Case No.180 of 2022 arising out of Chandipur P.S.Case No.72 of 2022 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate with further conditions that the Petitioner while on bail shall cooperate with the investigation and appear before the I.O. as and when required. He shall also appear before the trial court on each and every date fixed.

The Petitioner shall not threaten, influence, terrorise or harass the informant and his family members in any manner whatsoever while on bail.
