Heard learned counsel for the petitioner and learned Order No.

counsel for the State.

Present petition under Section 482 Cr.P.C. is filed for quashing of the order of NBW dated 19th July, 2022 passed in 2(C) CC Case No. 01/2016 pending in the court of learned J.M.F.C., Balasore on the grounds stated therein.

Learned counsel Mr. Zafarulla appearing for the petitioner submits that the petitioner was earlier on bail by order dated 8th June, 2016 in connection with the case for having committed an offence punishable under Section 160(2) of the Railways Act, however, on account of default dated 19th July, 2022, the learned J.M.F.C., Balasore before whom the case was pending and transferred issued NBW/A against him and considering the above

// 2 // facts and the fact that he was on bail, the petitioner should be directed to surrender and go on bail.

Considering the above submission, the Court although does not find any reason to interfere with the impugned order under Annexure-1 but allows the petitioner to surrender before the learned court in connection with 2(C) CC Case No. 01/2016 and in the event of his surrender, he is directed to be released on bail imposing conditions.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with the above direction.
