Heard learned counsel for the petitioner and learned counsel for the State.

The instant petition under Section 482 Cr.P.C. has been filed by the petitioners challenging the order dated 4th July, 2022, passed by the learned Addl. District & Special Judge, Bhanjanagar in NDPC No.03 of 2016 arising out of P.R. No.22 of 2016-17, for having issued the non-bailable warrant of arrest against them on the grounds stated therein.

Perused the impugned order under Annexure-1, whereby learned court below issued the order of NBWAs against the petitioners due to default which is absolutely justified and therefore calls for no interference. However, leaned counsel for the petitioners submits that the petitioners were on bail but due to their default, the order has been passed.

Having regard to the above submissions of learned counsel for the parties, the Court is inclined to direct the petitioners to surrender and move for bail. Accordingly, it is ordered. 5.

The petitioners are directed to surrender before the court below on or before 15th September, 2022 in NDPC No.03 of 2016, arising out of P.R. No.22 of 2016-17 and move for bail and in such an event, they shall be released on bail with conditions as deemed fit and proper by the court below.

The CRLMC application stands disposed of.
