Heard learned counsels for the parties.

Considering the submission of learned counsel for the Petitioner, Order No.01 dated 17.08.2022 passed in ABLAPL No.9812 of 2022 is hereby recalled, and the following order is passed afresh.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail in connection with Rairangpur P.S. Case No.192 of 2021 corresponding to the C.T. Case pending in the court of learned S.D.J.M., Rairangpur, for the offence punishable under Section 379, I.P.C.

Learned counsel for the Petitioner submits that the present F.I.R. has been lodged against unknown persons. However, the
// 2 // police is searching for the Petitioner in connection with the present case and there is every likelihood of the Petitioner to be implicated in this case.

Considering such submission, nature of allegation and the facts and circumstances of the case, it is directed that, in the event of arrest in connection with the aforesaid P.S. Case, the Petitioner shall be released on bail by the Arresting Officer on such terms and conditions as would be deemed just and proper in the facts and circumstances of the case, but subject to the condition that the Petitioner shall cooperate with the investigation and shall appear before the I.O. for the purpose of investigation, as and when required.

The ABLAPL and the I.A. are disposed of accordingly. 8.
