1. This matter is taken up through virtual mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 10th January, 2022 in connection with Gochhapada P.S.

Case No.04/2022 corresponding to C.T. Case No.4/2022 pending in the court of learned Sessions Judge-cum-Special Judge, Phulbani for the alleged commission of the offence under Section 20(b)(ii)(C) of NDPS Act.

4. The Petitioner had earlier approached this Court in BLAPL No.2172/2022, which was rejected granting liberty to the Petitioner to renew his prayer after submission of charge sheet. Charge sheet has been submitted in the mean time. This Court finds no change in circumstance inasmuch as the prosecution allegation that the Petitioner was the rider of one of the three motor cycles in which cumulatively 102 kgs. of ganja was transported.

5. Having regard to the above facts, I am not inclined to allow the prayer for bail, which is, therefore, rejected. (Sashikanta Mishra) AKB Judge
