Heard learned counsel for the petitioner and learned counsel for the State.

Mr. D.P. Dhal, learned senior counsel for the petitioner has filed memo of appearance the same be taken on record and name of Mr. Dhal be reflected on the file as well as in the cause list. 4.

The petitioner is an accused in G.R. Case No.417 of 2022 arising out of Padampur P.S. Case No.99 of 2022, pending in the file of learned S.D.J.M., Padampur, under Section 385/354/292/506/505/292(2)(a)/500 of IPC read with Section 67(A) of the I.T. Act and is in custody since 06.05.2022. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Padampur by order dated 02.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned senior counsel for the petitioner submits that since charge sheet has already been filed on 12.07.2022 and the petitioner is in custody since 06.05.2022, further continuance of the petitioner in custody is not warranted.

Learned counsel for the State opposes the prayer for bail submitting that the offence is well made out against the petitioner. 8.

Considering the nature of allegations and taking into account the age of the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
