This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.61 of 2021, pending in the file of learned Additional Sessions Judge-cumSpecial Judge, Gajapati, Paralakhemundi, arising out of Mohona P.S. Case No.88 of 2021, for commission of alleged offences under Sections 20(b)(ii)C/25/29 of NDPS Act and is in custody since 12.04.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Paralakhemundi, Gajapati by order dated 10.02.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Learned counsel for the petitioner does not want to press this bail application. The same accordingly stands disposed of as not pressed.

It is brought to the notice of this Court that in respect of co-accused, a coordinate Bench of this Court by order dated 29.06.2022 in BLAPL No.8946 of 2021 directed trial to be concluded within a period of four months from 29.06.2022. The learned Court is called upon to abide by such order and conclude the trial within the time already fixed by this Court. 7.

In the event trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer before the learned Court in seisin, which shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
