This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.841 of 2022, pending in the file of learned J.M.F.C., Chandikhol, arising out of Balichandrapur P.S. Case No.204 of 2022 under Section 376/506 of IPC and is in custody since 08.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge, Jajpur by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the petitioner is a handicapped person and that charge sheet has been filed on 27.07.2022 and considering the 164 Cr.P.C. statement of the victim, this Court
directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
