This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.19 of 2021, pending in the file of learned 5th Additional Sessions Judge, Bhubaneswar, arising out of Jatni P.S. Case No.16 of 2021 under Section 341/326/307/498-A and after charge sheet turned to under Section 302 of IPC and is in custody since 09.01.2021. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 5th Additional Sessions Judge, BBSR by order dated 11.07.2022 in the aforementioned case, the present BLAPL has been filed.

Since the trial has already commenced, this Court is not inclined to entertain this bail application at this stage. The same stands rejected.

Keeping in view that the petitioner is in custody since 09.01.2021, the learned Court is requested to conclude the trial within a period of three month from the date of receipt/production of certified copy of this order.

In the event the trial is not concluded within the time stipulated it is open to the petitioner to renew his prayer. 8.

Accordingly, the BLAPL stands disposed of.
