Petitioner in this CMP prays for a direction to learned Civil Judge (Senor Division), Angul to implead Opposite Party No.2, namely, Bidyadhar Nayak as a party to the suit. 3.

In course of hearing, Mr. Sahoo, learned counsel for the Petitioner fairly concedes that no such application has been filed before the learned trial Court. In view of the above, he prays for withdrawal of the CMP to work out the remedy in accordance with law.

In view of such submission, the CMP stands disposed of as withdrawn.
