This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.682 of 2022, pending in the file of learned S.D.J.M. Jharuguda, arising out of Belpahar P.S.
Case No.60 of under Section 448/294/323/307/506/34 of IPC and is in custody since 14.06.2022. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned ADJ-cum-Special Court under the POCO Act, Jharsuguda by order dated 05.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Learned counsel for the petitioner submits that since the charge sheet has been submitted and the nature of injuries have been categorized as simple, his further continuance is not warranted more so keeping in view the age of the petitioner.

Learned counsel for the State opposes the prayer stating that the manner in which the assault has been made petitioner ought not to be released on bail.

Taking into account the filing of charge sheet and keeping in view the age of the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every three months till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
