This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.31 of 2022, pending in the file of learned J.M.F.C. (R) Rajgangpur, arising out of Rajgangpur P.S. Case No.21 of 2022 under Section 376(2)(n) of the IPC and is in custody since 18.01.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge, Sundargarh by order dated 29.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement.

Considering the submission of the learned counsel for the petitioner and keeping in view that charge sheet has already been
filed, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
