This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.
This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

It is submitted by the learned counsel for the Petitioner that no specific allegation has been made against the Petitioner with regard to misappropriation. He also submits that all the allegations made in the F.I.R. against one Hemanta Kumar Dalei, who was Manager of the said Company. The Petitioner is no way connected with the alleged offences as alleged in the F.I.R. After leaving the company since long this false F.I.R, has been lodged only to harass the Petitioner.

Considering the nature of allegations made, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned S.D.J.M.,Berhampur in G.R.Case no.1434 of 2022 arising out of Berhampur Town P.S.Case No.164 of 2022 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate and subject to furnishing a cash security of Rs.30,000/- (Rupees Thirty thousand) which shall be invested in any interest bearing account in any Nationalised Bank in the name of the court in seisin over the matter. It is also directed that the Petitioner while on bail shall cooperate with the investigation and appear before the I.O. as and when required and shall appear before the trial court on each and every date fixed. Violation of condition shall entail cancellation of bail.

Accordingly, the ABLAPL is disposed of.
