This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special POCO Case No.50 of 2022, pending in the file of learned Additional District and Sessions Judge-cum-special Court under POCSO Act, Bhadrak, arising out of Chandbali P.S. Case No.195 of 2022 under Section 363/366/376(1)/376(2)(n) of IPC read with section 6 of POCSO Act and is in custody since 19.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned A.D.J.-cum-Special Court under POCSO Act, Bhadrak by order dated 03.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Taking into account the 164 Cr.P.C. statement of the victim and keeping in view that charge sheet has been filed on

28.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 6.

Accordingly, the BLAPL stands disposed of.
