This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.18 of 2022, pending in the file of learned Sessions Judge-cum-Special Judge, Jeypore, arising out of Baipariguda P.S. Case No.93 of 2022 under Section 20(b)(ii)C of the NDPS Act and is in custody since 18.04.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Jeypore by order dated 09.06.2022 in the aforementioned case, the present BLAPL has been filed.

The allegations against the petitioner is that he was involved in the transporting of Ganja in the tune of 26 kgs and 900 grams. Learned counsel for the petitioner submits that two of the

co-accused persons similarly placed were released on bail by this Court on 06.07.2022 in BLAPL No.5641 of 2022. Considering the same, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 6.

Accordingly, the BLAPL stands disposed of.
