This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Saintala P.S. Case No.130 of 2021, corresponding to G.R. Case No.127 of 2021, pending in the file of learned J.M.F.C., Saintala, for commission of alleged offences under Sections 302/34 I.P.C. 3.

Heard learned counsel for both the parties. Perused the FIR, Case Diary and statement of witnesses.

Learned counsel for the Petitioner submits that he does not want to press this bail application with liberty to file fresh bail application at a later stage, as the rejection order under challenge has been passed on 26.07.2021 and the charge-sheet has been filed on 12.09.2021.

In such view of the matter, the bail application is disposed of as withdraw with liberty as prayed for. In such event, the trial court shall consider the dispose of the bail application of the Petitioner on its own merits and in accordance with law.

With the above direction, the BLAPL is accordingly allowed.

Issue urgent certified copy of this order on proper application.
