This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.90 of 2022, pending in the file of learned Additional District & Sessions Judgecum-Presiding Officer, Special Court under POCSO Act, Mayurbhanj, Baripada, arising out of Thakurmunda P.S. Case No.62 of 2022 under Section 376(2)(n)/292/506 of IPC read with Section 6 and 12 of POCSO Act and Section 66(E) and 67 of the I.T. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Presiding Officer Spl. Court under POCSO Act, Mayurbhanj, Baripada by order dated 02.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations, this Court is not inclined to entertain this bail application. The same stands rejected. The consideration by the learned Court in seisin over the matter was during the course of investigation. 6.
The petitioner is at liberty to move the learned Court below after filing of charge sheet. The same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
