This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner submits that the description of the petitioner has wrongly stated. He is permitted to make necessary correction in Court.

The petitioner is an accused in C.T. Case No.196 of 2022, pending in the file of learned J.M.F.C. G. Udayagiri, arising out of Tikabali P.S. Case No.38 of 2022 under Section 379/34 of IPC and is in custody since 07.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Dist. & Sessions Judge, Balliguda Camp at G. Udaygiri by order dated 27.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Learned counsel for the State relying on the order of rejections submits that stringent condition to be imposed and accordingly, it is directed that the petitioner shall appear before the jurisdictional police station once in every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
