IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLREV No. 379 of 2022 Puja Behera @ Kaluni @ Anr.
...
Petitioners Mr. S.K. Dash, Advocate -Versus - State of Odisha & Anr.
....
Opp.Parties Mr. P. Tripathy, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
27.10.2022 1.
This matter is taken up through hybrid mode.
Order No.
2.
2.
Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.
3.
The petitioners (CCLs) are in custody since 21.06.2022 in connection with Tangi P.S.
Case No.290 of corresponding to JGR No.17 of 2022 pending in the Court of learned Addl. District and Sessions Judge-cum- P.O., Children's Court Khordha in Criminal Appeal No. 7/22 for the alleged commission of offence under Sections 498-A/304B/306 of IPC read with Section 4 of DP Act. 4.
It is alleged that the sister-in-law of the petitioners committed suicide as she was upset due to the fact that her mobile phone was taken away by her husband to mortgage it for purchasing a fan.
5.
A perusal of the social investigation report does not clearly reveal any allegation relating to cruelty in connection with demand for dowry.
6.
Considering the above fact as also the fact that charge sheet has already been submitted, I am inclined to allow the
prayer for bail. Let the petitioners (CCLs) be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail. 7.
CRLREV is accordingly disposed of.
8.
Issue urgent certified copy as per rules.
