This matter is taken up through hybrid mode.

This writ petition has been filed assailing the order dated 28th July, 2022 (Annexure-6) passed by learned Judge, Family Court, Dhenkanal in C.P. No. 84 of 2021, whereby he rejected an application filed by the present Petitioner (Respondent in the civil proceeding) under Order VII Rule 10 C.P.C.

In course of hearing, Mr. Sahoo, learned counsel submits that the Petitioner at present is facing difficulty to contest the case at Dhenkanal, which is 30 K.Ms. away from her parental house, where she is staying. He further submits that interest of justice will be best served, if the Petitioner files appropriate application for transfer of the civil proceeding to any competent Court of law at Kamakhyanagar. Hence, he prays for withdrawal of the writ petition to enable the Petitioner to move such an application. 4.

In view of the submission made, this writ petition is disposed of as withdrawn.

Certified copy of the impugned order under Annexure-6 shall be returned to the learned counsel for the Petitioner on substitution of attested photocopy thereof.

Urgent certified copy of this order be granted on proper application.
