This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Info Valley P.S. Case No.141 of 2022, corresponding to G.R. Case No.446 of 2022, pending before the learned J.M.F.C., Jatni, under Sections 341/294/307/325/506/34 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Khurda, Bhubaneswar by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that because of long standing enmity between the families, the incident had taken place and that the injured Bharat Pradhan, who has suffered grievous injury, has since been released from the hospital and leading a normal life and the other injured Mohan Majhi has suffered simple injuries.

It is submitted that the petitioner is a first offender and hence he may be released on bail.

Learned counsel for the State submits that release of the petitioner when the investigation is going on is not desirable. 8.

Taking into account the allegations and that injured have recovered in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
