This matter is taken up through virtual/physical mode. 1.

Petitioner is the Proprietor of M/s. Babuli Kumar Sishu who had availed multiple loan facilities from UCO Bank, Brajarajnagar Branch, DistrictJharsuguda and due to financial indiscipline the loan accounts were classified as NPA on 28.02.2018. Resultantly a demand notice under Section 13 (2) of the SARFAESI Act, 2002 was issued on 17.09.2018 recalling the aggregate liability of Rs.65,71,866/- due as on 28.02.2018. Thereafter symbolic possession was assumed and a sale notice dated 30.07.2022 was issued fixing the auction sale of one of the mortgaged properties offered as a collateral security on 29.08.2022.

2. It is the aforesaid demand notice and the sale notice which has been challenged before this Court.

3. At the time of hearing, learned counsel for the petitioner prays for an unconditional withdrawal of the writ petition.

4. The writ petition is accordingly dismissed as withdrawn.
