This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "(i) The Petitioner, therefore, most respectfully prays that your Lordship may graciously be pleased to admit this writ application and issue rule NISI to the Ops to show cause as to why they shall not be directed to grant financial up-gradation under the RACP scheme taking into account her initial date of appointment as 30.04.86 w.e.f. the date when her juniors were granted such financial up-gradation and release all other service and consequential benefits in her favour, to which she is entitled to;

And on their failing to show cause or showing insufficient cause the Rule be made absolute;

And further a direction be issued to the Ops to recommend the case of the petitioner fro grant of financial up-gradation under the MACP scheme like her juniors;

// 2 // And pass such further orders as may be deemed fit and proper in the facts and circumstances of the case"

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before the Opposite Party No.3 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opposite Party No.3 shall do well to dispose of the representation within a period of three months. The decision so taken by the Opposite Party No.3 be communicated to the Petitioner within that time. 6.

With the aforesaid observations and directions, the Writ Petition is disposed of.
