This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.166 of 2022 pending in the file of learned S.D.J.M., Karanjia, arising out of Karanjia P.S. Case No.105 of 2022, for offence under Sections 395/506 IPC and Section 25 of the Arms Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Karanjia by order dated 11.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the Petitioner that the Petitioner has been implicated in the case at hand because of his alleged criminal proclivity. It is submitted that no T.I Parade has

been conducted and the co-accused have been released on bail in BLAPL Nos.7309 of 2022 and 7344 of 2022 by this Court by order dated 27.09.2022 and on the ground of parity, the Petitioner may be released on bail.

Taking into account the nature of allegation and non conducting of T.I Parade and release of the co-accused, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 9.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station of the Court in seisin over the matter once in every week till conclusion of trial. 10.

Accordingly, the BLAPL stands disposed of.
