This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to the Sub-Collector, Anandapur and Superintending Engineer, Keonjhar Electrical Circle, TPNODL, Keonjhar to install a transformer and provide power supply to the Lift Irrigation Point of Petitioner under Biju Grama Jyoti Scheme.

It is submitted by learned counsel that the Petitioner had earlier approached this Court in W.P.(C) No. 14378 of 2017, which was disposed of on 6th September, 2019 with a direction to the Collector, Keonjhar to consider the representation of Petitioner in accordance with law and take a lawful decision thereon. Since the Collector, Keonjhar is not the appropriate authority to consider the grievance of the Petitioner, he made a representation to the Sub-Collector, Anandapur by registered post on 13th December, 2021, but no action has yet been taken on the same, which is still pending.

Considering the submission made by learned counsel for the Petitioner, this Court vide order dated 7th September, 2022 directed learned State Counsel to take instruction in the matter. Mr. Mishra, learned Additional Standing Counsel, on instruction, submits that the Sub-Collector, Anandapur could not find out the representation of the Petitioner dated 13th December, 2021 stated to have been sent by him by registered post. Since the prayer of Petitioner is to install a transformer and to provide power supply to the Lift Irrigation Point of Petitioner under Biju Grama Jyoti Scheme, he should approach the authorities under TPNODL for redressal of his grievance.

Taking into consideration the submissions made by learned counsel for the parties, this writ petition is disposed of with a direction that in the event the Petitioner files a detailed application before the Executive Engineer, A.E.D., TPNODL, AnandapurOpposite Party No.5 within a period of two weeks hence along with certified copy of this order, he shall do well to consider the same and take a decision thereon in accordance with law as expeditiously as possible preferably within a period of four weeks therefrom and communicate the result thereof to the Petitioner within that period. If the Petitioner is entitled to the relief for installation of transformer and providing power supply to the Lift Irrigation Point of the Petitioner under Biju Grama Jyoti Scheme, the same shall be done forthwith observing all formalities. 6.
It is made clear that this Court has not expressed any opinion on the merits of the case of the Petitioner. Urgent certified copy of this order be granted on proper application.
