This CMAPL has been filed for recalling the order dated 4th August, 2022 by which R.S.A. No.495 of 2018 was dismissed for non-prosecution and to restore the said appeal to file. 3.

Upon hearing learned counsel for the parties and on perusal of the case record, this Court feels that the order dismissing the appeal should be recalled and the appeal be restored to file.

Accordingly, the CMAPL is allowed. R.S.A. No.495 of 2018 is restored to its original number.
