1.This matter is taken up through hybrid arrangement.

2. Heard.

3. In this Writ Petition, the petitioner challenging the order of the entire disciplinary proceeding, order of memorandum of charges and also the final order of punishment on the ground that the Block Education Officer is not the competent authority as well as the Disciplinary Authority and lacks of jurisdiction to pass such impugned order.

4. Learned counsel for the petitioner submits that, the order passed by the Block Education Officer, Odagaon remove the present petitioner from service w.e.f. 31.08.2021 after the drawl of departmental proceedings. The said order is an appealable order before the Opposite

5. In such view of the matter, the petitioner is granted liberty to approach the Opposite Party No.2/Director Elementary Education, Odisha, Bhubaneswar in appeal.

6. Accordingly, the Writ Petition is disposed of.

7. Urgent certified copy of this order be granted on proper application.
