This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner, learned counsel for the State, learned counsel for the Informant and the victim through video conferencing.

The petitioner is accused in T.R. Case No.12 of 2022, pending in the Court of the learned Additional Sessions Judge-cumSpecial Judge (POCSO), Jeypore, arising out of Jeypore Mahila P.S. Case 100 of 2021, for alleged commission of offences under Sections 376(2)(n)/376(3)/498-A/34 of IPC read with Section 4(2) and 6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge (POCSO), Jeypore, by order dated 16.07.2022 in the aforementioned case, the present BLAPL has been filed.

Considering the nature of allegations, this Court is not inclined to entertain this bail application of the petitioner at this stage.

Since the petitioner is stated to be in custody since 09.12.2021, learned Court in seisin over the matter is called upon to conclude the trial within a period of three months from the date of receipt/production of this same order. In the event trial is not concluded within the time specified, it shall be open to the petitioner to move the learned Court in seisin over the matter afresh, after examination of the victim.

The Registry is requested to communicate this order to the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
