Heard Mr. N.Panda, learned counsel for the petitioner, Mr. S.S. Pradhan, learned Additional Government Advocate and Mr. B.K. Padhi, learned Central Government Counsel 2.

This Writ Petition has been filed by the petitioner with a prayer for recalling the order dated 02.11.2006 passed by the learned Civil Judge (Senior Division), Sambalpur in L.A. Case No. 76 of 1993.

Mr. Panda, submits that the impugned order arose out of a reference made under Section-18 of the Land Acquisitions Act, 1894 on account of the non-cooperative attitude of the Land Acquisition Officer in furnishing the names of the interested persons after death of his father at whose instance the above reference was made in order to continue with the reference.

Accordingly order dated 02.11.2006 was passed by the learned Civil Judge and the said case was returned to the file of the Land Acquisition Officer.

Mr. Pradhan, learned Additional Government Advocate submits that if the petitioner wants recalling of the order passed by the learned Civil Judge (Senior Division), then the petitioner should have approached the learned Civil Judge (Senior Division), Sambalpur instead of approaching this Court.

In such background, Mr. Panda, wants to withdraw this Writ Petition in order to approach the learned Civil Judge (Senior Division), Sambalpur for redressal of the grievances of the petitioner.

Considering such submissions, the Writ Petition is disposed of as withdrawn.
