This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Economic Offence Wing, Bhubaneswar P.S. Case No.05 of 2022 dated 14.03.2022, T.R. No. C.T. 3(C) of 2022 OPID, Balasore, pending in the file of the learned Additional Sessions Judge, Special Court, OPID, Balasore, Orissa, for alleged commission of offences under Sections 406/420/467/468/471/120-B of IPC, Section 66 of I.T. Act read with Sections 4,5 & 6 of Prize Chits & Money Circulation Schemes (Banning) Act, 2011 and Section 6 of OPID Act. 4.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned P.O. Designated Court, OPID, Balasore, by order dated 18.06.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that during pendency of the bail application charge-sheet was filed on 13.09.2022.

It is seen that the consideration by the learned Court in seisin over the matter was before filing of the charge-sheet. Hence, this Court is not inclined to entertain the bail application of the petitioner.

It shall be open to the petitioner to renew his prayer before the learned Court below and the same shall be considered on its own merits without being influenced by the earlier order passed or order passed by this Court.

Accordingly, the BLAPL stands disposed of.
