This matter is taken up through hybrid mode.

The Petitioner in this CMP prays for early disposal of C.S No.5 of 2011 pending before learned Civil Judge (Junior Division), Angul.

It is submitted by Mr. Mohanty, learned counsel that the Plaintiff-Petitioner is an old lady of sixty-six years. The suit has been filed for declaration of right over the suit land and for permanent injunction. Due to pendency of the suit, the PlaintiffPetitioner is seriously prejudiced. Hence, this CMP has been filed.

On perusal of the order sheets annexed to the CMP at Annexure-2, it appears that the suit is not ready for hearing. Thus, this Court is not in a position to grant any prayer made in this CMP.

However, keeping in mind that the suit is of the year, 2011, this Court disposes of the CMP with an observation that learned trial Court should make an endeavour for early disposal of C.S. No.5 of 2011, if there is no legal impediment.

Parties to the suit are also directed to cooperate with learned trial Court for early disposal of C.S. No.5 of 2011. Urgent certified copy of this order be granted on proper application.
