ORDER

24.03.2023 I.A. NO.574 OF 2023 06.

1.

This matter is taken up through hybrid arrangement Order No.

(physical / virtual) Mode.

2.

This is an application for modification of the condition imposed by order dated 11.11.2022 passed by this Court in ABLAPL No. 9946 of 2022 while directing Petitioners to be released on bail in the event of their arrest as regards deposit of cash of Rs.2,00,000/- each.

3.

Upon hearing learned Counsel for the Petitioners and the learned Counsel for the State as well as learned Counsel for the Informant and on going through the averments taken in the petition as also the order dated 11.11.2022 passed in ABLAPL No.9946 of 2022, the condition as to deposit as imposed for release of the Petitioners on bail is modified to the extent that each of the Petitioners without prejudice to their defence would deposit a cash of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand) before the said Court which shall be kept under long term fixed deposit in any Nationalized Bank and would be renewed from time to time as the Court

// 2 // deems proper; whose disbursement / release shall be subject to the final order as would be passed at the conclusion of the trial; and each of the Petitioners shall also furnish property security to the tune of Rs.50,000/- (Rupees Fifty Thousand). It is however needless to say that the Court below while accepting the property offered as security would arrive at a satisfaction that the same are free from all encumbrance and have not been given as security in any other case(s). In view of the above modification, the date fixed for surrender of the Petitioners before the Court in seisin of the case be extended by four weeks more with effect from today. 4.

The I.A. is accordingly disposed of.

Issue urgent certified copy as per rules.

(D.Dash), Judge.
