This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Gopalpur P.S. Case No.107 of 2022 corresponding to G.R. Case No.1229 of 2022, pending in the file of learned S.D.J.M., Berhampur, under Sections 420/465/467/468/34 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Berhampur, by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the petitioner relies on the orders passed by this Court by order dated 16.08.2022, 22.08.2022 and 26.08.2022 in BLAPL No.7085, 7189 and 7609 of respectively and seeks release inter alia on the ground of parity.

Taking into account the role ascribed to the petitioner and release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

It is further directed that the petitioner shall appear before the jurisdictional police station once every fifteen days till submission of final form.

Accordingly, the BLAPL stands disposed of.
