The petitioner is an accused in C.T. Case No. 06 of 2015 on the file of the learned Addl. Dist. & Sessions Judge-cumSpecial. Judge, Boudh arising out of Boudh P.S. Case No. 06 of 2015 alleged for commission of offence Under Sections20(b)(ii)(c) of the NDPS Act. 3.

Being aggrieved by the rejection of his application for bail U/Sec. 439 Cr.P.C by the learned. Addl. Dist. & Sessions Judge-cum- Special. Judge, Boudh by Order dtd. 03.09.2020 in Spl. Case No. 15 of 2015 (NDPS Act), the present BLAPL has been filed.

Heard Mr. S.K. Padhy, learned counsel for the petitioner and Mr. K.K. Gaya, learned counsel for the State.

Taking note of submission that the co-accused have already been released on bail by this Court by order dated 01.12.2016 in BLAPL No. 4949 of 2015 and taking into account that the petitioner is in custody since 10.01.2015, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter, so as to ensure his presence on each date of trial.
