This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the parties.

The I.A. has been filed for the petitioner no.1. 4.
It is submitted by leaned counsel for the petitioner no.1 that while this Court passing order, petitioner no.2-Purushatam @ Purosttam Mandal was directed to surrender before the learned court below on such terms and conditions and petitioner no.1-Bijjay Kumar Mandal was directed to surrender 1st hour and 2nd hour. 5.
It is further submitted that the injuries sustained by the injured are simple in nature. Hence, modification has been prayed for. 6.
Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner no.1-Bijay Kumar Mandal. However, it is directed that in the event the petitioner no.1-Bijay Kumar Mandal surrenders and moves an application for bail before the learned court in seisin over
// 2 // the matter within a period of three weeks from today in the aforesaid case, he shall be released on bail on such terms and conditions as would be deemed just and proper .

Four weeks' further time from today is extended for the petitioner to surrender before the learned court below, vide order dated 22.08.2022 passed in ABLAPL No.9952 of 2022, but subject to depositing cost of Rs.500/- (Rupees five hundred) in the Advocates' Welfare Fund of Orissa High Court Bar Association within fifteen days and furnishing money receipt thereof in proof of deposit.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of accordingly.
Urgent certified copy of this order be granted on proper application.
